Decisões multilaterais controversas: um estudo da resolução 1929 do conselho de segurança da ONU

RESUMO
A aprovação de uma resolução obrigatória do Conselho de Segurança ocorre a partir da votação das nações que compõe o conselho, quando argumentos e razões para a resolução são apresentados. Esse é o caso da resolução 1929, que propõe uma sanção ao Irã por suspeita de uso de seu programa nuclear para fins bélicos. A resolução 1929 pode ser utilizada como exemplo para entender o processo de adoção de uma sanção multilateral contra um Estado. Serão discutidas, a partir de diferentes autores, as críticas cabíveis a uma resolução tal como a 1929, especialmente nos termos de efetividade, amplitude, equidade, soberania e efeitos na população civil do país sancionado. A partir do exposto, propõe-se um debate sobre a legitimidade que o Conselho de Segurança da ONU detém no cenário mundial.

ABSTRACT
The adoption of a binding resolution of the Security Council occurs from the vote of the nations that compose the council, when arguments and reasons for the resolution are presented. This is the case of the 1929 resolution, which proposes a sanction against Iran due to the suspicion of use of its nuclear program for war purposes. The resolution 1929 can be used as an example to understand the process of adoption of a multilateral sanction against a State. The applicable criticism on a resolution such as the 1929 will be discussed from different authors, especially in terms of effectiveness, amplitude, fairness, sovereignty and effects on the civilian population of the sanctioned country. From the foregoing, it is proposed a debate on the legitimacy that the UN Security Council holds on the world stage.
