Prolégomènes pour une théorie normativiste de "l'état de droit"

RÉSUMÈ
Cet article traite de la théorie normativiste de Hans Kelsen sur “l‘Etat de Droit”. Selon Kelsen, État et Droit sont des termes équivalents. Ainsi, l'expression “État de Droit” se trouve pléonastique. Initialement, à partir de cet énoncé nous pourrions en déduire que l'État Nazi a suivi “l´État de Droit”. Il suffit de citer ces lignes pour supprimer la pertinence de toute théorie normative de “l´État de Droit”. En d'autres termes, il est de défendre strictement un concept formel et un concept matériel de “l´État de Droit”, et une théorie normative permet de construire tous les deux à la fois avec précision.

ABSTRACT
This article discusses Hans Kelsen´s normativist theory on the “rule of law”. According to Kelsen, State and Law are equivalent terms. So, the expression “rule of law” happens to be pleonastic. Initially, from this enunciation we could deduce that the Nazi State followed the “rule of law”. Just quote these lines to remove the relevance of all normative theory of the rule of law. In other words, it is to defend strictly a formal concept and a material concept of rule of law, and a normative theory allows to build both accurately.
